Prop 8 Battle Continues in SF Federal Court
A hearing in US District Court will be held today. Plaintiffs seek to overturn Proposition 8. Chief Judge Vaughn Walker has indicated that he will probably deny a request for an injunction that would reverse the proposition while the case is being heard. However, it is likely that the matter will be fast-tracked to trial.
California Governor Schwarzenegger and Attorney General Jerry Brown are both named as defendants in the lawsuit. They have argued, pro forma, in support of maintaining Proposition 8. However, both have stated their opposition to the same-sex marriage ban. This leaves any form of vigorous advocacy in the hands of third parties. Presumably, these will likely include the Pacific Justice Institute and the Alliance Defense Fund. Both are Christian public interest legal organizations.
