Would This Nice Man and His Daughter Lie to You?

TVC Sheldon-LaffertyYou bet your ass they would. That is Louis Sheldon and his daughter, Andrea Lafferty, of Traditional Values Coalition. They have managed to compile an impressive assortment of lies, innuendo, fear mongering  and distortions into a single email blast. About the only thing that stands up to scrutiny is the fact that there is a hate crimes bill under consideration in the Senate and it is "S.909." Apparently truth is not a traditional value.

URGENT ACTION NEEDED ON ‘JAIL-A-PASTOR/PROTECT-A-PEDOPHILE’ BILL. Your immediate help is needed!!!  -- The Senate Judiciary Committee will be holding a hearing on the so-called hate crimes bill (S. 909), the Matthew Shepard Hate Crimes Prevention Act, this coming Thursday at 10 a.m.

Well that part us accurate too. There is, indeed, a hearing on Thursday morning. Eric Holder is scheduled to testify.

S. 909 is a “jail-a-pastor/protect-a-pedophile,” bill.  It will add “sexual orientation” and “gender identity” as protected minority groups under federal law. Neither of these terms are defined in the bill. 

Sexual orientation and sexual identity are clearly defined terms. There is nothing ambiguous about either.

S. 909, the so-called hate crimes bill will protect a multitude of bizarre sexual orientations – including pedophiles and sexual sadists – but will threaten pastors who may give a Biblical teaching on the gay agenda. It ensures that crimes against a transgender, drag queen, gay man or lesbian are treated more harshly than a sexual assault on a child. Under this measure, pedophiles are a protected class. As a result, if a parent assaults a pedophile for molesting a child, the parent can be convicted of a hate crime and receive an enhanced sentence. The Senate version is based on fake “Findings” to justify federal intrusion into local law enforcement.

Utter nonsense and a pants on fire lie. Sexual orientation is an enduring pattern of emotional, romantic, and/or sexual attractions to men, women, both genders, neither gender, or another gender. Pedophilia is not a sexual orientation.

The Senate version has no religious protection at all. The House version contained fake protections. A pastor’s sermon could be considered ‘hate speech’ under this legislation if heard by an individual who then acts aggressively against persons based on ‘sexual orientation.’ The pastor could be prosecuted for “conspiracy to commit a hate crime.”

False.

(3) CONSTITUTIONAL PROTECTIONS

Nothing in this Act shall be construed to prohibit any constitutionally protected speech, expressive conduct or activities (regardless of whether compelled by, or central to, a system of religious belief), including the exercise of religion protected by the First Amendment and peaceful picketing or demonstration. The Constitution does not protect speech, conduct or activities consisting of planning for, conspiring to commit, or committing an act of violence.

(4) FREE EXPRESSION

Nothing in this Act shall be construed to allow prosecution based solely upon an individual’s expression of racial, religious, political, or other beliefs or solely upon an individual’s membership in a group advocating or espousing such beliefs.

The last time I checked, the First Amendment was still in place. Moreover, Intent or knowledge is a key factor In third-party responsibility for crimes (aiding and abetting - USC 18:2). Indeed, it would constitute an insult to the First Amendment if speakers or publishers could unwittingly cause crimes for which they then could be held responsible. Example: In spite of his vitriolic rhetoric, Randall Terry is not legally responsible for the murder of Dr. Tiller.

During debate over the House version of this bill (H.R. 1913), Democrat Alcee Hastings (FL) admitted that this bill will protect a multitude of bizarre sexual orientations!

False. Congressman Hastings never said anything that could be construed as TVC has suggested.

Don’t be misled.  Representatives and Senators are sending out misinformation about this legislation and what it will do or not do. Claims that it protects religious freedom are false; claims that it doesn’t protect a multitude of bizarre sexual orientations are also false.

… blah, blah, blah and, of course, send us your money! It takes balls on bicycles to tell this many falsehoods and then caution people not to be misled. This should really be an insult to the collective intelligence of their constituency. Unfortunately, that is unlikely to be the case.

My goodness, David.  You sure have attracted a good number of angry people with your post.   What I find most interesting is that while they viciously denounce the notion of adding LGBT people to existing hate-crimes legislation not a one of them has suggested eradicating the protections they themselves enjoy based on their race, religion and other factors.  I wonder why that is?

The text of S909 Fed hate Crime bill

‘(1) OFFENSES INVOLVING ACTUAL OR PERCEIVED RACE, COLOR, RELIGION, OR NATIONAL ORIGIN- Whoever, whether or not acting under color of law, willfully causes bodily injury to any person or, through the use of fire, a firearm, a dangerous weapon, or an explosive or incendiary device, attempts to cause bodily injury to any person, because of the actual or perceived race, color, religion, or national origin of any person--

 

So this bill would make it a Federal Hate crime to shoot someone with a gun or throw an explosive device at them for reason of bias (race, gender, sexual orientation, country of national origin)

 

Hey idiots! Attempted murder for ANY REASON including bias is against the law in all 50 states! Murder is against the law!

Wyoming doesn't have a high murder rate, the District of Columbia, the South Side of Chicago (not including the Obama's military defended Kenwood neighborhood) has very high murder/crime rates.

All murders are hateful crimes, but some hateful crimes are apparently more hateful than others, thus the murder and mayhem of the Black Gangster Disciples, Latin Kings, Mexican Mafia, original Mafia - this doesn't count in the brave new PC world of Hate Crimes/Thought Crimes.

*%$## Hate Crime/Thought crime laws!

Americans should be free to write/say/think what we want.

Is there any ambiguity now based upon race, religion, gender, country of national origin? Because federal hate crime laws already exist for those groups. Are there any cases that would be examples of such confusion? Is it not perfectly obvious that shooting someone in self defense is not a crime to begin with?

Apparently, you have not read the bill or you might be able to offer a more intellectually honest argument in opposition. The reasons for hate crimes laws are very simple. These laws have existed for many years.

1. As a society, we have determined that a violent crime committed because of race, religion, etc is more heinous than those committed for other reasons. Therefore, there are sentence enhancements.

2. Hate crimes are often committed by groups of people. Investigations can be arduous and expensive. Hate crimes laws allow local law enforcement to request federal assistance in the form of people, money or both.

3. Some local law  enforcement is particularly indifferent to hate crimes due to bias. Sheriff Bubba might not want to arrest a prominent white man for the murder of a black man. He might conclude that a gay crime victim was asking for it. "Flaunting it" is the usual excuse. Hate crimes laws allow federal law enforcement to intervene when local law enforcement fails to do its job because of their prejudices.

 Regurgitating the "thought crime" talking point is even more dishonest than the moronic talking point itself. This is about violent crime. If something is not a crime now, it cannot be a crime under federal hate crime laws.

What a ridiculous commentary.

The proposed Federal Hate Crime bill seeks to bring EU/Canadian style politicalization of crime prosecutions and strongly attack the 1st Amendment rights of Americans to speak/write their views on politics, marriage laws, issues of immigration etc. Please note that it wasn't just Conservatives, Right Wing Christians, Nationalists who were persecuted in Europe and Canada for saying or "thinking" politically incorrect thoughts - beautiful French film star Brigitte Bardot was persecuted for speaking out against mass muslim immigration into France and certain Muslim sects abuse of animals. In Europe Canadian publisher Ezra Levant was put before the Alberta Human Rights Commission/Inquisition for publishing cartoons poking fun at violent Muslim extremists.

As for Alcee Hastings - he most certainly did list a long list of sexual perversions including necrophilia (sex with dead bodies) that needed to be protected under the proposed Fed Hate Crime Bill.

The Fed Hate Crime bill is lying, PC, BS. Violent crime for any reason, including bias against certain groups is illegal in every state. The famous case of Matthew Shepard - in Wyoming a state with very low murder rates shows that these laws aren't need. The criminals who murdered Matthew Shepard received life in prison, barely escaping the death penalty. Gays and lesbians are generally safe living in Wyoming as they don't get murdered there.

In contrast, my Chicago has 500 plus murders a year, whole state of Wyoming has ~ 14. Gangs like the Black Gangster Disciples murder people in Chicago - but I guess these hateful crimes of murder aren't "hate crimes".

Americans are sick of lying PC, multi cult BS like the proposed Federal Hate Crime law.

As a victim of a hate crime based upon sexual orientation who has been threatened with death for attempting to pursue state court legal remedies against my attackers here in Illinois, I think perhaps a few "born-again christians" like the ones who have stalked me since 2004 because of civil rights work I did over 20 years ago which is just now appearing on the internet should be prosecuted and have their rights taken away under this or any available law.

I hope it does tame the "Gospel of Hate".

Those who advocate murder and mayhem in the name of "jesus" need to have their wings clipped or pay taxes, whichever they hate more.

 Seeks? This bill is what it is. It reinforces 1st Amendment protections as is quoted in the article. Furthermore, we are not in Europe. We are not part of Canada. The First Amendment can only be amended with two thirds of both houses and two thirds of states concurring.

As for Alcee Hastings - he most certainly did list a long list of sexual perversions

 I actually watched the session on CSPAN. Hastings was ridiculing a GOP Rep. (Geohmert I recall) for having recited that list which has nothing to do with the bill.

I must remind you that federal hate crimes laws already exist. This bill amends those to include sexual orientation and identity. BTW, Laramie very much needed such a bill. Without the grant money provided by this bill, they had to lay off about 25% of their police force due to the expense of the investigation.

Read the actual bill before you comment. You are attacking legislation that does not exist.
